Application: Finger Chooser - Party Games

1. Introduction

These Terms of Service ("Terms") govern your access to and use of Finger Chooser - Party Games (the "Application", "App", or "Service").

By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.

These Terms should be read together with our Privacy Policy and Subscription Terms.

2. Platform Terms

If you download the App from the applicable app marketplace, your use of the App may also be subject to the terms, rules, and policies of the relevant platform.

In the event of a conflict between these Terms and mandatory platform rules, the applicable platform rules may control to the extent required.

3. Eligibility and Age Requirements

By downloading, accessing, or using the Application, you represent and warrant that you are at least 18 years of age (or the legal age of majority in your jurisdiction) and have the full legal capacity to enter into these Terms.

If you are under 18 years old, you are strictly prohibited from using the Application. We reserve the right to terminate your access to the Service immediately if we discover that you do not meet these age requirements.

4. License to Use the App

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use, unless we expressly permit otherwise.

You do not acquire ownership of the App, software, source code, design, content, trademarks, or other intellectual property.

5. Acceptable Use

You agree not to:

  • use the App for unlawful, harmful, fraudulent, abusive, or deceptive purposes;
  • reverse engineer, decompile, modify, copy, distribute, sell, lease, or sublicense the App except where permitted by law;
  • bypass subscription, payment, entitlement, access control, security, or technical restrictions;
  • interfere with or disrupt the App, servers, networks, billing systems, or third-party services;
  • use automated scripts, bots, scraping, or unauthorized access methods;
  • upload, create, import, share, or send content that infringes rights, violates laws, or harms others;
  • use party game prompts, random selections, or results to harass, bully, coerce, endanger, or unlawfully discriminate against others;
  • use the App in a way that violates the applicable app marketplace or third-party service policies.

6. App Features and Changes

The App provides random decision tools and party games, including finger chooser, group divider, ranking, Would You Rather, Most Likely To, Truth or Dare, 5 Sec Challenge, coin flip, lucky wheel, random number, rock-paper-scissors, customization, sounds, vibration, and related features.

We may add, modify, suspend, or remove features from time to time. Some features may require an internet connection, device permissions, app store account, active subscription, compatible device, supported operating system, or third-party service availability.

We do not guarantee that all features will be available at all times, in all countries, on all devices, or in all app versions.

7. Local Data and Backups

Some data may be stored locally on your device. You are responsible for managing, exporting, and backing up your local data where supported. Deleting the App, changing devices, clearing storage, or system failure may result in loss of local data.

8. User Content

You retain ownership of content you create, import, attach, share, or send through the App, subject to any rights you grant to us to operate the App and provide the requested feature.

By using features that process user-selected content, you represent that you have the necessary rights and permissions to use that content.

9. No Professional Advice

The App provides entertainment, party game, random decision, and general utility functions only. Random selections, game prompts, rankings, and party results should not be treated as legal, medical, financial, tax, investment, safety, emergency, or other professional advice.

You remain responsible for your own decisions and should consult qualified professionals where appropriate.

10. Subscriptions and Paid Features

The App may offer paid features, subscriptions, premium content, increased usage, personalization, themes, game modes, or other premium services.

Purchases made through the applicable app marketplace are processed by the relevant platform. Subscription terms, billing, cancellation, renewal, and refund rules are described in our Subscription Terms and the applicable app marketplace rules.

11. Third-Party Services

The App may integrate with third-party services, SDKs, APIs, platforms, app stores, payment processors, advertising networks, analytics providers, crash reporting tools, remote configuration services, attribution services, backend APIs, or support tools.

Third-party services may be subject to their own terms and privacy policies. We are not responsible for third-party services, content, availability, security, or practices, except as required by applicable law.

12. Intellectual Property

The App, including software, design, interface, graphics, logos, text, features, and other materials, is owned by us or our licensors and is protected by intellectual property laws.

You may not use our name, trademarks, branding, or assets without prior written permission.

13. Feedback

If you provide feedback, suggestions, ideas, or bug reports, you grant us a worldwide, royalty-free, perpetual, irrevocable license to use them for any purpose without compensation, unless prohibited by law.

14. Termination

We may suspend or terminate your access to the App if you violate these Terms, misuse the App, create legal risk, violate platform rules, or harm other users, us, or third parties.

You may stop using the App at any time. Uninstalling the App does not automatically cancel an active subscription. You must cancel subscriptions through the applicable app marketplace settings.

15. Disclaimers

The App is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, non-infringement, and uninterrupted operation.

We do not guarantee that the App will be error-free, secure, compatible with all devices, available at all times, or meet your expectations.

16. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities arising from or related to your use of the App.

To the maximum extent permitted by law, our total liability for any claim related to the App will not exceed the greater of the amount you paid for the App or subscription during the twelve months before the claim arose, or the minimum amount that cannot be excluded under applicable law.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

17. Indemnification

You agree to defend, indemnify, and hold harmless us, our affiliates, officers, employees, contractors, and partners from any claims, liabilities, damages, losses, and expenses arising from your use of the App, your content, your violation of these Terms, or your violation of any law or third-party rights, to the extent permitted by applicable law.

18. Applicable Law and Mandatory Rights

These Terms will be interpreted and applied in accordance with applicable laws and any mandatory consumer protection, privacy, data protection, subscription, refund, or other legal rights that may apply to you based on your country or region of residence.

Nothing in these Terms limits any rights that cannot be excluded or waived under applicable law.

19. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted in the App, on our website, or through other appropriate channels. The "Last Updated" date indicates when these Terms were last revised.

Your continued use of the App after changes become effective means you accept the updated Terms, unless applicable law requires additional consent.
